Prop 65 Web Statement

The Safe Drinking Water and Toxic Enforcement Act of 1986, commonly known as Proposition 65, is a California law intended to protect residents and state drinking water sources from chemicals known by the State of California to cause cancer or reproductive toxicity.

Currently, over 900 “known” chemicals are included on California’s ever-growing Proposition 65 List. Under the law, a business cannot “knowingly and intentionally” expose an individual to a consumer product containing a chemical on the Proposition 65 List without first providing a “clear and reasonable” warning to such individual. To comply, businesses are required to provide a “right-to-know” warning, using content or methods specified by the law, for products containing a listed chemical where the anticipated level of exposure is above the “safe harbor” level.

The state of California has established safe harbor levels for over 300 listed chemicals. Unfortunately, businesses with products containing one of more than 500 listed chemicals without an established “safe harbor” are required to provide a warning, unless it can show that the anticipated exposure level will not pose a significant risk of cancer or reproductive harm. California acknowledges that determining anticipated exposure and safe harbor levels is complex and businesses often opt instead to provide “right-to-know” warnings. As a result, a Proposition 65 warning does not necessarily mean that the level of exposure is high enough to pose “a significant risk” to the consumer.

Proposition 65 does not require businesses to perform testing. To help ensure product safety, Bird & Cronin relies on information provided by our raw material and component suppliers; including test results, safety data sheets (SDS), and declarations to establish the presence of listed chemicals and the need to provide a warning. Based on current knowledge, Bird and Cronin products are in compliance with Proposition 65. Products manufactured or distributed by Bird & Cronin that could expose users to chemicals known to the State of California to cause cancer and/or which are known to cause birth defects or other reproductive harm are listed below.
